Acceptable Use Policy

This Acceptable Use Policy (the “AUP”) describes activities and content that are prohibited on the Pelagio platform. It applies to all users of the Service, including Studios, their End Users, and Pelagio account holders. Pelagio operates as a Payment Facilitator under sponsorship from Finix Payments, Inc.; restrictions imposed by Finix or by card networks are incorporated here by reference.

Prohibited business categories

You may not use the Service to accept payments for, promote, or facilitate the following categories:

  • Illegal goods or services in any jurisdiction where the transaction occurs.
  • Drug paraphernalia, controlled substances, or cannabis sales beyond what is permitted by federal and state law and accepted by Finix in writing.
  • Tobacco, vaping, e-cigarettes, and related products.
  • Firearms, ammunition, weapons, and weapon parts.
  • Adult content, sexual services, and adult entertainment.
  • Gambling, lotteries, sweepstakes, and skill games involving cash prizes.
  • Multi-level marketing, pyramid schemes, and chain-letter arrangements.
  • Cryptocurrency exchange or money transmission.
  • Counterfeit goods, replicas, and intellectual-property-infringing items.
  • Aggregation of payments on behalf of third parties not onboarded as Sub-merchants.
  • Any category prohibited by Finix risk policy or by the card networks (Visa, Mastercard, American Express, Discover) as updated from time to time.

Prohibited conduct

  • Fraud, including misrepresenting goods or services and accepting payments for transactions that will not be fulfilled.
  • Money laundering, sanctions evasion, or transactions involving sanctioned persons or jurisdictions.
  • Use of the Service in violation of any applicable law, including consumer-protection, tax, AML, KYC, and data-protection laws.
  • Attempts to disrupt, probe, scan, or test the security of the Service without prior written authorization.
  • Unauthorized access to accounts, data, or systems, including credential stuffing and social engineering.
  • Sending unlawful or unsolicited communications through the Service’s messaging features.
  • Reverse engineering, decompiling, or extracting source code or models from the Service.
  • Reselling, sublicensing, or providing the Service to third parties except through Pelagio’s authorized partner programs.
  • Any conduct that imposes unreasonable load on the Service or interferes with other users.

Children

The Service is for users 16 and older. If a Studio offers classes for minors under 16, the booking and payment must be made by a parent or guardian who is an account holder. Studios must not collect personal information from children under 16 except as necessary for class attendance and only with parental consent.

Reporting violations

If you believe a Studio or other user is violating this AUP, please report it to abuse@pelagioapp.com. Include the studio name, a description of the violation, and any supporting evidence. We investigate every report and may share information with Finix or law-enforcement authorities where appropriate.

Enforcement

Pelagio may suspend or terminate the Service for any user who violates this AUP, with or without notice depending on the severity and on legal and platform-integrity considerations. Finix may independently terminate a Sub-merchant account based on its own risk policy.

Changes

We may update this AUP from time to time. Material changes will be posted with at least 30 days’ notice, except changes required for legal, security, or card-network compliance which may take effect immediately.
