These Terms of Service ("Terms") govern your access to and use of Pelagio's studio management platform, including our website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Acceptance of Terms

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users of the Service, including studio owners, instructors, staff members, and clients.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and your agreement to these Terms will be treated as the agreement of the organization.

3. Use of Service

Pelagio grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your studio management needs. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use any automated system to access the Service in a manner that sends more requests than a human can reasonably produce
• Transmit any viruses, worms, defects, or other items of a destructive nature
• Use the Service to transmit any unsolicited or unauthorized advertising or promotional materials

4. Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to maintain and update this information to keep it accurate, current, and complete.

You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Pelagio will not be liable for any loss or damage arising from your failure to comply with these requirements.

5. Payment & Billing

Certain features of the Service require payment of fees. You agree to pay all applicable fees as described on our pricing page. All fees are non-refundable except as expressly stated in these Terms or required by law.

For subscription plans, you authorize Pelagio to charge your payment method on a recurring basis according to your selected billing cycle (monthly or annual). Your subscription will automatically renew unless you cancel it before the renewal date.

Transaction fees apply to payments processed through the Service. These fees vary by payment method (Visa, Mastercard, Discover, American Express) and are clearly disclosed on our pricing page. You are responsible for all transaction fees associated with payments you process.

We reserve the right to change our fees at any time. If we change our fees, we will provide you with at least 30 days' notice before the change takes effect. Your continued use of the Service after the fee change takes effect constitutes your agreement to pay the modified fees.

6. Cancellation Policy

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of your current billing period, after which it will not renew. You will not receive a refund for any unused portion of your subscription.

We reserve the right to suspend or terminate your account if you violate these Terms or if your payment method fails. If we terminate your account for cause, you will not be entitled to a refund of any fees paid.

7. Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Pelagio, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain all rights to the content you upload to the Service, including class schedules, client information, and other data. By uploading content, you grant Pelagio a worldwide, non-exclusive, royalty-free license to use, store, and display such content solely for the purpose of providing the Service to you.

8. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will Pelagio, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall Pelagio's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to Pelagio in the twelve (12) months prior to the claim.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to our collection and use of information as described in our Privacy Policy.

10. Changes to Terms

We reserve the right to modify these Terms at any time.
